These Terms of Service ("Terms") govern your use of the HeySetter platform ("Service"), operated by BigBang Goals, Inc., a Delaware corporation ("we", "us", "our"), accessible at heysetter.com and app.heysetter.com. By accessing or using our Service, you agree to be bound by these Terms.
1. Description of Service
Setter is an AI-powered sales agent platform that operates through WhatsApp on behalf of your business. The Service includes:
- AI-powered conversation management
- Appointment scheduling
- Knowledge base management
- Lead follow-up automation
- A business dashboard
2. Account Registration
2.1 You must provide accurate and complete information when creating an account.
2.2 You are responsible for maintaining the security of your account credentials.
2.3 You must be at least 18 years old to use our Service.
2.4 One account per business. Multiple accounts for the same business are not permitted.
3. Acceptable Use
You agree to use the Service only for lawful business purposes. You will NOT:
- Send spam, unsolicited messages, or bulk marketing without consent
- Use the AI agent to deceive, mislead, or defraud customers
- Violate WhatsApp Business Policy or Meta Platform Terms
- Attempt to reverse-engineer, copy, or replicate our AI systems
- Use the Service for any illegal activity
- Transmit harmful, offensive, or discriminatory content through the AI agent
- Exceed your plan's usage limits without upgrading
4. WhatsApp Compliance
4.1 You are responsible for ensuring your use of the AI agent complies with WhatsApp Business Policy and applicable messaging laws.
4.2 You must have appropriate consent from recipients before the AI agent contacts them.
4.3 You acknowledge that Meta (WhatsApp) may suspend or restrict messaging capabilities at any time based on their policies.
4.4 We are not responsible for WhatsApp account restrictions resulting from your messaging practices.
5. AI-Generated Content
5.1 Responses generated by the AI agent are automated and may contain errors or inaccuracies.
5.2 You are responsible for reviewing and configuring your AI agent's behavior through system prompts and knowledge base content.
5.3 We do not guarantee that AI responses will be accurate, appropriate, or suitable for your specific business needs.
5.4 You are ultimately responsible for all communications sent through the AI agent to your customers.
6. Data Ownership
6.1 You retain ownership of all content you provide to the Service, including business information, knowledge base documents, and system prompts.
6.2 You grant us a limited license to process your content solely to provide the Service.
6.3 Conversation data between your AI agent and your customers is stored in your account and accessible through your dashboard.
6.4 Upon account termination, you may request export of your data within 30 days.
7. Service Availability
7.1 We strive for high availability but do not guarantee uninterrupted service.
7.2 The Service depends on third-party providers (WhatsApp, OpenAI, hosting providers) whose availability is beyond our control.
7.3 We may perform maintenance that temporarily affects availability, with reasonable notice when possible.
8. Pricing and Billing
8.1 The Service is offered under a single plan at USD $350 per month, which includes every feature and 3,000 unique conversations per billing month. Additional unique conversations beyond that threshold are billed at USD $0.08 each. We also offer Setter Premium, an enterprise offering quoted individually on a call.
8.2 Billing is processed monthly; current pricing is available at heysetter.com.
8.3 We reserve the right to modify pricing with 30 days notice to existing customers.
8.4 Refunds are handled on a case-by-case basis.
8.5 A "unique conversation" is counted once per distinct end customer phone number that exchanges at least one message with your agent during a billing month, regardless of how many messages that exchange contains or how many times the conversation is reopened within the same billing month. The counter resets at the start of each billing month. Your current count is visible in your dashboard at all times.
8.6 New accounts include a 7-day free trial that does not require a payment method. If no payment method is added before the trial ends, the account is suspended rather than charged, and your data is retained under the terms of Section 10.
9. Limitation of Liability
9.1 THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
9.2 We are not liable for:
- Lost revenue or business opportunities resulting from AI agent behavior
- WhatsApp service interruptions
- Third-party service failures
- Data loss beyond our reasonable control
9.3 Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
10. Termination
10.1 You may cancel your account at any time through the dashboard or by contacting support@heysetter.com.
10.2 We may suspend or terminate your account for violation of these Terms, with notice when practicable.
10.3 Upon termination, your AI agent will stop processing messages. Your data will be retained for 30 days before deletion unless you request earlier deletion.
11. Governing Law
These Terms shall be governed by the laws of the Republic of Colombia. Any disputes shall be resolved in the courts of Bogota, Colombia.
12. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via email.
